Terms of ServiceEffective date: September 23, 2026 · Last updated: September 23, 2026These Terms of Service (the “Terms”) are the contract between you and Curbshot for curbshot.app, the Curbshot iOS and Android apps, homeowner share links, and related services (the “Service”). We operate from the United States. Contact: hello@curbshot.app.By creating a shop, signing in, connecting payments, or using the Service, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use Curbshot. These Terms are also the end user license agreement (EULA) for the Curbshot iOS and Android apps.The productCurbshot is photo proof and optional payment collection for small trade shops. A shop shoots before and after photos on the job, seals proof, shares an unlisted link or PDF, and may collect payment from a homeowner through Stripe. Photo bytes live in private Cloudflare R2. The website and API run on Laravel Forge.Curbshot records what was shot and helps you request payment. It is not a warranty of the trade work, not insurance, and not legal advice. A PDF or share page is evidence of photos and timestamps — not a certificate that the work meets code.Who may use itYou must be at least 18 and able to form a contract. You use Curbshot as a business customer (a shop), not as a consumer buying a toy. If you open an account for a company, you represent that you can bind that company to these Terms.Shop accountsYou need a shop account to shoot and sync. Do not share logins. You are responsible for activity on the account, including what every signed-in device uploads. Keep the password to yourself. If you think the account is compromised, reset the password and email hello@curbshot.app.One shop may sign in on more than one device (for example a phone and a tablet). That is still one shop.Your photos and contentThe shop owns the photos, job names, notes, logos, and other content it uploads (“Shop Content”). You represent that you have the right to shoot and share that content — including houses, streets, and people who appear in driveway photos — and that sharing it does not violate law or someone else’s rights.You grant Curbshot a worldwide, non-exclusive license to store Shop Content, stamp photos, generate PDFs, sync to your devices, serve share and pay links, and operate payments features, only to run the Service. That license ends when the content is deleted, except for copies a homeowner already downloaded or that we must keep under law (see Privacy Policy).We do not claim ownership of your photos. We do not sell them. We do not put them in ads.Share and pay linksA share or pay link is unlisted, not secret. Anyone with the URL can view what you sent. Homeowners do not create Curbshot shop accounts. You choose who gets the link. If you send it to the wrong person, that is on the shop. Deleting the job or the account makes the link stop working.Acceptable useDo not use Curbshot to:
•Break the law, harass anyone, or share photos you have no right to share
•Upload malware, probe, or disrupt the Service
•Resell the Service as if you were Curbshot, scrape other shops’ data, or try to access another shop’s jobs
•Misrepresent line items, fake proof, or collect payment for work you did not perform
We can suspend or delete an account for abuse, fraud, or a legal demand. We will try to email you first when that is reasonable.Payments (Stripe Connect)Curbshot is free to download and use for proof. There is no Curbshot subscription and no monthly fee for jobs, camera, share links, or PDF export.When you collect payment through Curbshot, money moves through Stripe. Stripe is the payment processor. Curbshot is not a bank and is not the merchant of record for the homeowner’s card payment. You connect your own Stripe Connect account. You are responsible for completing Stripe’s onboarding and for the accuracy of your business and payout details.On each successful payment collected through Curbshot for an invoice whose grand total is $50.00 (USD) or more, Curbshot collects a flat processing fee of $4.95 (USD) via Stripe’s application fee on that charge. Customer-facing materials and receipts label this a processing fee.You control whether that processing fee is added to what the homeowner pays:
•Always add fee (default): the homeowner is charged your invoice total plus $4.95, and the receipt may show a “Processing fee $4.95” line.
•Never add fee: the homeowner is charged your invoice total only; the $4.95 is still collected by Curbshot from that payment, so your net is reduced by the processing fee (in addition to Stripe’s own card fees).
•Choose per job: you set a per-invoice toggle when you create the invoice.
Invoices under $50.00 have no Curbshot processing fee. The homeowner pays your invoice total only (plus any tax you included), and we do not take an application fee on that payment.Whether a processing fee is due, and whether it is passed through to the homeowner, is determined on our servers when the payment session is created and is recorded for that session. Later edits to the invoice or your shop setting do not change an already-created payment session.Stripe also charges its own card processing fees. On Connect direct charges those card fees are settled against your connected Stripe account and are separate from Curbshot’s $4.95 processing fee. What you receive depends on whether you passed the processing fee to the homeowner and on Stripe’s timing and rules.You set invoice line items and amounts. If you charge tax, you enter it. You are responsible for deciding whether tax applies, for remitting tax, and for any tax advice. Curbshot does not calculate sales tax for you.Refunds, chargebacks, and disputes follow Stripe’s process and your connected account’s terms. Failed payments do not incur the $4.95 processing fee. Only successful collections on invoices of $50.00 or more do. Prices are in US dollars. We may change the processing fee for future payments; material changes will be posted on this page or in the product before they apply.Account deletionYou may delete the shop at any time from Settings in the app (Delete account) or by emailing hello@curbshot.app. Deletion removes the shop, users, jobs, photos, device tokens, and share links as described in the Privacy Policy. Stripe payout history and records Stripe or the law require may remain. Disconnecting Stripe does not by itself delete your Curbshot shop. There is no undo. A homeowner who already saved a PDF or a photo still has their copy.App Store downloads — Apple is not a partyIf you download Curbshot from the Apple App Store, you acknowledge:
•These Terms are between you and Curbshot only. Apple is not a party to this contract and is not responsible for the app or its content.
•Apple has no obligation to provide maintenance or support for Curbshot.
•To the maximum extent permitted by law, Apple has no warranty obligation. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (if you paid Apple any). Apple has no other warranty obligation with respect to the app.
•Apple is not responsible for claims relating to the app or your possession and use of it, including product liability, failure of the app to conform to legal or regulatory requirements, and claims under consumer protection law.
•Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the app or your use of it infringes that third party’s intellectual property rights.
•You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
•Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
Questions about the app, billing on the website, or these Terms go to Curbshot at hello@curbshot.app, not to Apple.Google Play downloadsIf you download Curbshot from Google Play, these Terms are between you and Curbshot. Google is not a party to this contract and is not responsible for the app or for subscriptions purchased on the website through Stripe.Service availabilityThe app is built to keep working on a driveway with no signal: jobs and photos save on the phone and sync later. Share links, pay links, and Stripe need the network. We do not promise uninterrupted uptime. We may change, suspend, or discontinue features. Offline copies on your phone are your working set; keep your own backups of anything you cannot afford to lose.Disclaimer of warrantiesTHE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURBSHOT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that stamps, timestamps, PDFs, or share pages will be admitted in every dispute, or that photos will be stored forever if you do not pay or if you delete the account.Limitation of liabilityTO THE MAXIMUM EXTENT PERMITTED BY LAW, CURBSHOT IS NOT LIABLE FOR LOST PROFITS, LOST DATA, COST OF SUBSTITUTE SERVICES, OR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE IS LIMITED TO THE GREATER OF (A) THE PLATFORM FEES YOU PAID CURBSHOT IN THE 12 MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).Some states do not allow certain limitations. In those states, our liability is limited to the maximum extent permitted by that state’s law. These Terms do not limit liability that cannot be limited, such as liability for death or personal injury caused by our gross negligence where that bar is not allowed.IndemnityYou will defend and indemnify Curbshot against claims, damages, and reasonable legal fees arising from Shop Content, your invoices, tax positions, your use of Stripe, your use of the Service, your share or pay links, or your breach of these Terms, except to the extent a claim is caused by our willful misconduct.Intellectual propertyCurbshot, the Curbshot mark, the asphalt design, and the software are ours (or our licensors’). These Terms do not give you a license to copy the product, scrape it, or reverse engineer it except where the law says you may. Shop Content stays yours, subject to the license above.Changes to these TermsWe may update these Terms. The date at the top will change. Material changes will be posted on this page. If you keep using the Service after an update, you accept the new Terms. If you do not, delete the account and stop using Curbshot.South Carolina law and disputesThese Terms are governed by the laws of the State of South Carolina, United States, without regard to conflict-of-law rules. You and Curbshot submit to the exclusive jurisdiction of the state and federal courts located in South Carolina, except that we may seek injunctive relief in any court to protect the Service or intellectual property. You and we waive a jury trial to the extent the law allows. If a court finds a section unenforceable, the rest still applies.MiscellaneousThese Terms and the Privacy Policy are the entire agreement for the Service. They replace prior terms. You may not assign the account without our written consent; we may assign these Terms in a sale of the product. Failure to enforce a provision is not a waiver. There are no third-party beneficiaries except Apple as stated above for App Store downloads.Curbshot is the name of the product and the operator identified in these Terms.
